Terms of Service

1. Scope and provider
These Terms govern access to and use of Nodify, a service provided by Matikus, Lda., Startup Madeira – EV 289, Campus da Penteada, 9020-105 Funchal, Madeira, Portugal, NIPC 519 513 630. By creating an account or using Nodify, you agree to these Terms. If you use Nodify for an organisation, you confirm that you have authority to bind that organisation.
2. The Nodify service
Nodify lets account holders create tracked call-to-action buttons, embed them in email signatures or other permitted locations, receive confirmed interaction alerts through configured channels, and review related analytics. Usage limits are described on the pricing page.
Nodify is a communication tool, not an emergency, safety-critical, medical, legal, or financial service. You must not rely on it where delayed or failed delivery could cause harm.
3. Accounts and security
- You must provide accurate account information and keep it current.
- You are responsible for safeguarding your password and notification-channel credentials and for activity performed through your account.
- You must notify us promptly at tech@matikus.com if you suspect unauthorised access.
- You must be at least 18 years old or otherwise legally able to enter into this agreement.
4. Customer content and privacy obligations
You retain your rights in button text, messages, destination details, and other content you submit. You grant Matikus, Lda. the limited permission needed to host, process, transmit, and display that content solely to operate Nodify.
You are responsible for ensuring that your content, button placement, contact-form use, and notification destinations comply with applicable law and do not infringe third-party rights. Where you collect personal data through Nodify, you must provide an appropriate privacy notice and establish a valid legal basis.
5. Acceptable use
You must not use Nodify to:
- Send spam, facilitate phishing, impersonate another person, or mislead recipients about a button’s purpose.
- Collect special-category data, payment-card data, passwords, or other information that Nodify is not designed to receive.
- Distribute malware, violate intellectual-property or privacy rights, or engage in unlawful, abusive, or fraudulent activity.
- Probe, bypass, disrupt, reverse engineer, or overload the service or its security and usage controls, except where applicable law expressly permits it.
- Use automated traffic or repeated interactions to manipulate analytics or quotas.
6. Plans, payment, and renewal
Nodify offers Pro monthly or annual subscriptions with a 14-day free trial for eligible accounts. One trial is available per account. New accounts can preview a button before subscribing; notification delivery requires Pro. Accounts with an existing Free allowance retain it. Current prices, included limits, billing period, taxes, and renewal details are shown before checkout. Usage limits reset as described in the product interface.
The trial starts only when you confirm checkout and provide a payment method. No subscription payment is collected during the free trial. Unless you cancel before the first payment date shown at checkout, your selected subscription begins automatically and your payment method is charged for the monthly or annual billing period. We send an email reminder three days before the trial ends. You can manage or cancel your subscription from Billing in your account. Returning subscribers who have already used a trial or had a subscription pay the price shown at checkout without a new trial.
When Pro access ends, notification delivery is paused for accounts without an existing Free allowance. Their saved designs and account remain available in preview mode. Existing Free accounts return to their original limits. Resources above the applicable limits may be archived or deactivated without being deleted.
Paid transactions are completed through Creem / Armitage Labs OÜ. Creem acts as merchant of record and contractual seller for the transaction, processes payment, calculates and collects applicable taxes, issues invoices, and handles payment-related administration. Creem’s buyer terms presented during checkout also apply to the purchase.
Unless the checkout states otherwise, subscriptions renew for the selected billing period until cancelled. Cancellation and refund options are governed by the information presented at checkout, Creem’s applicable buyer terms, and mandatory consumer law. Nothing in these Terms limits statutory cancellation, withdrawal, refund, or warranty rights.
7. Availability and changes
We aim to keep Nodify available and reliable but do not promise uninterrupted or error-free operation. Maintenance, security incidents, upstream provider failures, or events outside our reasonable control may affect availability. We may improve, replace, or discontinue features, and will provide reasonable notice when a material change adversely affects a paid subscription where practicable.
8. Suspension and termination
You may stop using Nodify and delete your account through the account area. Before deleting an account with a renewing subscription, cancel that subscription from Billing so that no further payments are collected. We may restrict or suspend access when reasonably necessary to address security risks, unlawful use, non-payment, material breach, or harm to Nodify or others. We may terminate an account for a material breach that is not remedied after notice, or immediately where delay would create material risk or where required by law.
9. Liability
Matikus, Lda. remains liable where liability cannot lawfully be limited, including for intent, gross negligence, death or personal injury caused by negligence, and mandatory consumer rights. To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost business opportunities, or failures caused by customer-configured third-party destinations or other services outside our reasonable control.
10. Governing law and disputes
These Terms are governed by Portuguese law. The courts of Portugal have jurisdiction, except where mandatory consumer law gives you the right to bring a claim in another competent court or requires another law to apply. Please contact us first at tech@matikus.com so we can try to resolve a concern informally.
11. Changes to these Terms
We may update these Terms to reflect service, provider, security, or legal changes. The current version and update date are published here. If a material change affects an existing paid subscription, we will provide reasonable advance notice where required.
